Not every case is appropriate for an appeal or writ of mandamus. It is not enough to be unhappy with the outcome at the trial court level. The key is whether the court committed reversible error, and determining that is a lengthy and detailed process. At Kellie Price Law, PLLC, we utilize a three-step consultation process for appeals.
The first step is the initial consultation. This includes an interview with the potential client, consulting with trial counsel when possible, reviewing the trial court’s order for potential error, and gathering other relevant information. Because appellate deadlines happen fast, initial consultations must be scheduled quickly, requiring the firm to pause work on other cases. Accordingly, initial consultations are scheduled only after the $225 nonrefundable flat fee is paid. Once you have paid the consultation fee, you should schedule in the first available calendar opening.
After the initial consultation, the second step is a full review of the trial record following the signing of an attorney fee contract. This full review will determine whether error was committed, whether the error is reversible, and whether the issues were preserved. In order to undertake the full review of the trial record, Kellie Price Law will collect a retainer in an amount to be determined based on the size of the record and complexity of the issues. Following the review of the record, Kellie Price Law will advise whether an appeal can be brought and which issues are strongest. Step three is then the drafting and filing of the appellate brief.
